Eligibility / Patient
You must be 18 years old or over to qualify for a Maine medical marijuana card. Applicants can either be residents of Maine or visiting qualifying patients.
Caregiver
A caregiver is a person 21 years old or older who is designated by a qualifying patient and authorized to assist the qualifying patient with the medical use of marijuana. Caregivers may serve up to five patients.
Can Minors Qualify?
Yes. A minor patient will require parent/legal guardian consent and at least one parent/legal guardian to act as their caregiver. A minor patient must take their parent or legal guardian to the dispensary to purchase their medication.
For a minor medical marijuana card certification, a birth certificate is an acceptable form of ID. We will also need the caregiver’s ID on file.

Medical Marijuana Recommendation
Once approved, your licensed physician will register you with the state and upload a digital image of your certification to Leafwell within 48 business hours (you will receive an email notification when it is available to download).

Medical Records (only required for minor patients)
Medical records are optional for adult patients but required for minor patients.

You will need a government-issued photo ID, such as a valid driver’s license from the state of Maine or a state ID card. For minor patients, a birth certificate is an acceptable form of identification.

Legal Topics
Maine has passed several pieces of legislation designed to protect its patients. Under the Maine Medical Use of Marijuana Act (MMUMA), an employer may not refuse employment or penalize a person for that person’s status as a qualifying patient. However, this does not require employers to accommodate the use of cannabis in any workplace or to allow employees to work while under the influence of marijuana.
Maine medical marijuana patients also have the right to:
- Enroll in school without rejection based only on cardholder status.
- Rent an apartment without eviction or refusal based solely on patient status.
- Work at their place of employment without discrimination for having a card or testing positive for marijuana.
- Receive healthcare without disqualification merely due to medical marijuana treatment.
- Visit or have custody of their child without denial only based on patient status.
- Hold a state-issued license without suspension on the sole basis of cardholder status.
However, a medical marijuana card may also prohibit a qualifying patient from:
- Owning a firearm.
- Prevent them from getting/keeping a federal job or a job that requires a commercial driver’s license.
Caregivers
A caregiver is a person who is designated by a qualifying patient and authorized to assist the qualifying patient with the medical use of marijuana.
Minor patients will require parent/legal guardian consent and at least one parent/legal guardian to act as a caregiver.
Caregiver Requirements:
- At least 21 years old.
- Must register with the state if NOT a family member of the patient.
- Never convicted of a drug offense. A background check is required ($31 fee).
- Caregivers may serve up to five patients.
- Special circumstances allow patients to designate a second caregiver. Only specified qualifying patients may have two primary caregivers.
- In addition to a minor qualifying patient, the following qualifying patients may designate a second primary caregiver:
- An incapacitated adult qualifying patient. An incapacitated adult qualifying patient’s legal guardian or power of attorney for health care shall serve as the incapacitated adult’s primary caregiver. In addition, an incapacitated adult qualifying patient may have a second primary caregiver.
- Qualifying patient in a hospice or nursing facility. The qualifying patient’s hospice provider or nursing facility may serve only as the qualifying patient’s non-cultivating primary caregiver. In addition, the qualifying patient may have a second primary caregiver designated to cultivate marijuana or to assist with the qualifying patient’s medical use of marijuana.
- In addition to a minor qualifying patient, the following qualifying patients may designate a second primary caregiver:
Caregiver Registration Information
- Fees
- Annual licensing fee (for caregivers who cultivate, per patient) = $240
- Background check fee = $31
- Hospice inpatient programs and nursing facilities designated as primary caregivers = no fee
- Caregivers who wish to cultivate must pay $240 annually per patient, plus an additional $31 for background checks.
- A caregiver who assists a patient who is not a member of their family or household must register with the state.
Reciprocity
DMedical cannabis patients visiting Maine need only produce their state-issued registry identification card, certificate, or other state-issued documentation of the visiting patient’s status as a medical cannabis patient in their state of residence to purchase medical cannabis while visiting Maine.

- Access the online caregiver application portal.
- From the Main Menu, choose "Individuals."
- Applicants will have the option to "Apply for an Individual Caregiver Registration" or "Renew an Individual Caregiver Registration."
- If your registration has passed its expiration date, choose "Apply for an Individual Caregiver Registration." You can only use the renewal option if your card is currently still active.
- The "Upload Outstanding Application Documents" will allow the applicant to upload any documents that were not present during the application process at a later time.
- Applicants will be asked if they have ever held any type of license in the medical program, which includes a prior caregiver registration, a caregiver assistant registration, or a dispensary assistant registration. Answering this correctly will link your new application to your existing profile in OCP's system and make processing your application much faster.
- Provide your personal information: name, date of birth, and social security number.
- Provide your state-issued photo ID information and a unique Maine Revenue Services Registration Certificate number (Retailer and/or Resaler).
- Provide your personal contact information including addresses, personal phone number, and personal email address.
- Continue to add additional addresses until all applicable addresses are provided, including:
- Mailing Address
- Street Location (this is the applicant's current personal residential address and five years of prior addresses, if different)
- Grow Location (up to two, there may be separate locations for mature plans and immature plants)
- Manufacturing Location
- Retail Location
- Wholesale Storage Location
- Continue to add additional addresses until all applicable addresses are provided, including:
- Provide the name and address of the property owner of each property, as well as any "Doing Business As Name" the applicant may use.
- Indicate all authorized activities the caregiver will be engaged in.
- Ex. If selecting "Standard caregiver cultivation activities", also indicate which activity or activities best describes what happens to harvested cannabis.
- The applicant will indicate a cultivation level.
- Please note the "No authorization to grow/sell Medical Cannabis" is the option to choose for long-term care facilities and schools assisting a qualified patient pursuant to Title 22 § 2423-A(1)(F-1)(2) and (4).
- Indicate if you have ever been convicted of a violation of a state or federal controlled substance law.
- Upload a copy of your state-issued photo ID (like a Maine driver's license) and, if applicable to your caregiver activities, scale certification(s), pesticide applicator license, commercial or home food establishment license, retail food establishment license, beverage plant license, and business organization documents.
- Read and attest to the Maine Medical Use of Cannabis Program qualifying statements.
- Indicate if the Maine Office of Cannabis Policy has completed a background check in the past 12 months.
- If you cannot remember the date of your last background check, please call OCP to check, as answering this question incorrectly can delay the processing of your application.
- Review, attest, and agree to the information submitted in the application.
- You will receive a confirmation email at the email address provided during the application process.
- If the applicant indicates it has been over 12 months since the last background check, there will be an application fee notice attached for the $31.00 background check fee. You must submit this fee for your application to continue moving forward through the process.
- Once the application is deemed complete, you'll receive a confirmation email with an Application Fee Notice attached for the fee.
- The annual licensing fee for caregivers is $240 per patient.
- There is no licensing fee for caregivers of patients in hospice or nursing facilities.
- Once the application is approved and the licensing fee is paid, the caregiver registry identification card will be issued, printed, and mailed to the caregiver.

- The provider will register you with the state, print your physical certification on tamper-proof paper, and mail it to you. In addition, they will upload a digital image of your certification to Leafwell within 48 hours.
